To give informed consent, a person must have all relevant facts at the time consent is given. In other words, a person must first be informed before he or she can consent.
In a legal case, a decision can have risks that you are not aware of. For example, if you ask an attorney if you can quit your job and start a business that competes with your former employer, the lawyer must advise you about the risks of doing so (for example, you could be sued by your former employer). The lawyer must explain the law in a way that a lay person can understand.
Too often, legal malpractice is the result of an attorney taking on a case that he or she is not qualified to handle. If a lawyer is not competent to advise a client in a certain matter, he or she should gain that knowledge or refer the case to someone who is competent. Unfortunately, once you make a decision based on poor advice, there may be no going back.
