Is the Property Owner Responsible for My Injury?
The law determining liability is complex. If you are injured after slipping on a foreign substance spilled on the floor of a store, the store may or may not be responsible, depending on how long the substance had been on the floor. If the store manager knew about the spill and had an opportunity to clean it up, the store may be responsible.
If you slip on ice, the property owner may not be responsible if the ice is the result of natural accumulation from rain or snow. However, there are situations when the property owner or someone else may be responsible:
- If the accumulation of ice is caused by a defective downspout, the company that designed or installed the downspout may be responsible.
- If the icy area was caused by a snow removal company that dumped snow next to a building, that company may be responsible.
- If the accumulation of ice was caused by sewer work that was not cleaned up, the city may be responsible.
- If an automatic door traps snow and water in an entryway, the company that designed the door may be responsible.
