Streets and highways are dangerous places, especially when drivers are not paying complete attention to traffic conditions and other vehicles around them. This might be the case in a recent fatal accident in Chicago on Division Street near the Kennedy Expressway.
The fatal incident began when a minivan was involved in a minor accident with a truck. The truck driver was taking photos of the collision damage when he was struck and killed by a second truck. The victim was pinned underneath the second truck’s wheels, which happened to be a garbage truck. There is no word on whether charges might be filed against the driver of the second truck.
The driver of the minivan was not hurt, but was transported to a nearby medical center for evaluation after she claimed she was traumatized by the incident.
Any negligent party who is held legally responsible for the loss of life in an accident can be named as a defendant in a wrongful death lawsuit filed on behalf of a victim by surviving family members.
An untimely and unexpected death has many effects on a victim’s family. If the victim was a breadwinner, his or her death could result in lost income that can destabilize household finances. A death can also leave a spouse without help in raising and providing for any children.
